Sir:
In answer to your letter of the 16th inst. reporting the alleged death of Milburn Wordier, late Pvt. Co B 21st U.S.C.T. and requesting information as to whether the widow or the child of said soldier shall be instructed to apply to the Second Auditor for new settlement in the event of the amount in the case being deposited to the credit of the United States, I have to state that whilst the widow is, in fact, a preferred heir under the law, the letter from this office of July 18, 1873, (referred to in your letter) was not intended to be construed as enjoining upon the disbursing officer the duty of deciding
