and that he died at Brownsville Texas in August 1865, leaving no wife, child or father living, and that the said Emaline and her son were owned by the father of the affiant.

It appears from the records that there was but one John Smith in said company who died in the service, and the settlement was made by this office in that case, not in case of a discharged man.
