Busy morning. dictating letters wrote to [[underline]]Blank[[/underline]] cancel appointment because I [[underline]]do not [[/underline]] care to have him in our group.  He is too slow and petty I wonder how he will like it?  At noon [[underline]] Sperry [[/underline]] has conference with engineer of Börnig and with Traub. took lunch ([[Brucklings?]] and [[junger?]] Hühn) at Pschorr's.  Dictated more letters then went out for a stroll thru [[underlined]] Sieqerallee.  good Statuary [[/underlined]]. - Bronze statue amazon) [[strikethrough]][[underline]]horseback[[/underline]][[/strikethrough]]. Thierqarten well kept park.  At 8 P.M. Took supper at Liebruck's.  And [[saw?]] there also a lieutenant All seemed very cheerful.  Drove off at 11 P.M.  Took glass beer Pschorr's thence to bed.

At 9:30 was called up by 'phone from  [[underlined]] Segall [[/underlined]] to make appointment for 11 A.M. [[underlined]] at Hechts [[/underlined]]  Went there somewhat sooner to talk over matters with him.  Main discussion with Segall was as to [[underlined]] percentage of my participation. [[/underlined]]  Main trouble is still patent situation. more particularly [[underlined]] Lebach's [[/underlined]] assertions Therefore I voluntarily proposed to settle all matters by making option voluntary on the part of Rutgers, this [[underlined]] voluntary option

to expire November 1 or three months later with fine of $1000 for [[/underlined]] every month's extension so that by Februar 1.10 their option has expired and I am free to deal with others unless they accept contract as it is and by paying $25000 as first installment of the $125000
