I have already sent you copies of instructions from Genl. Howard respecting rents of restored plantations, of dates Sept. 29" and Oct. 10" Washington. The substance of these instructions is that owners shall receive the entire years rent yet unpaid at the time of restoration, expenses deducted, provided, they can show to my satisfaction that the property has not been "abandoned": that others shall receive a fractional part of the years rent equal to the fractional part of the year subsequent to the pardon, or beginning the amnesty oath; expenses of collecting to be shared in the same proportion.
Any rents paid in previous to the date of pardon will not be returned. Claimants must be left to their legal remedy if any exists for them.
In both cases (as above) "if the owner desires it he should be allowed to collect the crop, giving such security as may be proper that he will turn over to the Bureau its proportional parts of the rents. This is not, however to be understood as forbidding you to collect the crop should such proceedings be satisfactory to both parties."
With the taxes we have nothing to do. The tax commissioner will be able to answer all inquiries on that subject.

In reply to your communication of the 21" Inst. I have the honor to state that in the case of Wiley Tanner there has been no departure from the instructions of Gen. Howard, approved by President Johnson.
No evidence has been placed before me to show that the said Tanner was born free, or that he has been apprenticed to any one.
When such evidence shall be produced & the master will promise or give bonds that "no distinction shall be made on account of color," I shall be happy to reconsider the case.

I don't think this is correct. I think it is a typo on the Instructions. It is Whittlesey. Do a Google Search and see his name in numerous other publications. I have contacted the organisation to request clarification. @kdownunder **The Asst. Commissioner's name is Col. Eliphalet (Eli) Whittlesey. The name was incorrectly transcribed on the example page. This has been corrected.
