Dept. of N.C. 191/225 Colonel: We have a large amount of clothing, hospital stores, and Sanitary Stores lately received from the quartermaster's Dept. and Sanitary Commission, now in stores at these Headquarters, and are daily expecting the arrival of about four hundred (400) packages more. To protect these stores whilst they are being distributed to the different Districts of the State, I respectfully request that a detail of three (3) men be made from this Military Port to report to me as a guard for that purpose. I would respectfully invite your attention to the enclosed article cut from the "New Berne Times" and request that Bvt. Maj. H.C. Lawrence A.Q.M. be relieved and ordered to report to the Bureau of Refugees, Freedmen &c at Washington D.C. In reply to your note of inquiry respecting Hospital buildings in Raleigh, I have the honor to request that all the Govt. buildings now used for Hospital purposes viz. the "Pettigrew" & Fair Grounds Hospitals" be turned over to Capt. Thos. P. Johnston A.Q.M. for the use of this Bureau when no longer needed for Military purposes. With those buildings in our possession, we shall be able to provide Offices, Asylums, Hospitals, School Houses & Quarters for teachers, with but little expense. Very Respectfully E. Sir Your favor of the 10" is just received. In the matters referred to, it will not be difficult to avoid conflict of jurisdiction. The principles by which Military Authorities are grounded are these: 1" In cases of breach of criminal law by freedmen no objection will be made to trial by Civil Courts. (Colored testimony being by law admitted), provided the [[underlined]] sentence [[/underlined]] against whites & blacks when convicted be necessarily the same. 2" In cases where whites are accused of offences against colored people (colored testimony not yet being admitted), the military authorities claim jurisdiction. Should the bill now before the Legislature be passed, these cases will be transferred to the Civil Courts also, on the same condition as the first. It is my earnest desire to see this effected at an early day. Then the most objectionable feature of the Freedmens Bureau will be removed.
