I have the honor to enclose Capt. Seely's report & letters on the Case of the State vs Sarah Richardson, for your information.  As the case now stands, it being probable that the testimony will be admitted without distinction of color of the witnesses I have advised Capt. Seely to withdraw his objection to the trial by Civil Court.
I request that these papers be returned for file in my office.

In reply to your communication respecting the house of Dr. Masters in New Bern, I have the honor to state applications have been made by him to every officer of the Bureau, to Gen. Ruger and to Gov. Worth;  all of which have been patiently investigated and answered.
Enough of the correspondence on the subject to make it clear will be the following from my endorsement book. [[Footnote 1]]
The above are endorsements on the last applications of Dr. Masters.  There are in New Bern no Govt. buildings which can be used as quarters or offices.  It would be difficult to rent other buildings - & to [[underlined]] seize [[/underlined]] them would subject other persons to inconvenience.

Your letter respecting the Marine Hospital is received.  I am willing to leave the matter with you and the other officers.  I should think the Hospital accommodation already provided ample.  And if Mr. Ashley will fit up the Marine H. for an Asylum it appears to me the best use it can be put to.  But it should first be known whether the building can remain permanently where it now is, and whether the location is a good one for the purpose;  and whether the Soc. which Mr. A. represents will buy the building.

Enclosed I return the letter of Mr. Oliver.  I intended that the matter should be referred to impartial umpires in case you cannot compromise.  I should not object to your paying as high as $50. per month, though it is an exorbitant rent.
I would suggest that the buildings on the Wharf at Morehead City be devoted to the purpose indicated in Genl. Rugers order.
