Comr. directs me to say that he desires you if possible to assign some agent to duty in Asheville.  If no one can be found, properly qualified & willing to act, the sub-dist. will be added to the sub-dist. of Morganton.

I am directed by the Asst. comr. to call your attention to the expense of maintaining the Bureau in & near New Berne.  Far more expense has been & is yet incurred there than in any other entire District.  From the scarcity of funds now, and the uncertainty as to whether further supply can be readily obtained, it becomes necessary to exercise the very strictest economy.

I have the honor to acknowledge the receipt of your letter of 11" inst. calling my attention to an act of the General Assembly of North Carolina passed in 1865, and to the Ordinances of the State Convention repealing the proviso to the 9" Section of said act & so modifying the 11" Section that "there now exists under the laws of the State no discrimination in the administration of justice to the prejudice of free persons of color";  and desiring to be officially informed how in any opinion the question of jurisdiction now stands in matters relating to freedmen.

In reply I have the pleasure to inform your Excellency, that I have this day issued an order (a copy of which is enclosed) directing the Officers and Agents of the Freedmens Bureau to refer all cases to which freedmen are parties to the proper County or State Courts, with the single exception of claims for wages due under contracts approved or witnessed by officers of the Bureau.  I have made this exception for the reason that the condition of the freedmen is believed to be such that they cannot be subjected to the delay sometimes incident to proceedings in Civil Courts.
Trusting that any action may prove satisfactory to the Civil authorities, and that there will be no obstacles to the fair administration to all persons.
