Sir,

I am directed by the Asst. Comr. to acknowledge the receipt of your letter of yesterday.  I enclose a copy of an order under which it is to be presumed Capt. Shaffer acted.  He has been informed that unless the Civil Courts had been applied to - and the officers of the law declined or neglected to take action in the case of Davis that his arrest was unjustifiable and that Davis will be at once released.  If that course, however, has been taken - and the case comes under G.O. No.3 enclosed - the arrest is valid.

The matter of Bail can be decided after it is seen whether or not Davis was properly arrested.

Capt.

It having been reported to these Hd. Qrs. that you committed a man named R. M. Davis to confinement on the 18" Inst. for an assault of a Freedman, I am directed to request your particular attention to the closing paragraph of G.O. 3. C.S. from these Hd. Qrs.  You are instructed that it is your duty to make arrests [[underlined]] only [[/underlined]] in cases where the Civil Courts have been applied to, and either refuse or delay to bring the offender to justice.  Unless some such circumstances have governed your action, you will at once release the man Davis.  [[Footnote 1]]

Colonel,

In regard to completing the barracks at the Lyon Pasture Plantation - I am instructed by the Asst. Comr. today that you will please cause the requisite amount of material, such as nails, locks, hinges &c. to be purchased, and the requisite amount of labor to be hired to at once finish and make fit for occupation the 2 barracks now enclosed and roofed - A corn crib, and the church now ready for erection.  The 2 barracks already framed, but not enclosed or roofed will be allowed to remain as they are until the necessity appears for completing, of which necessity you will please advise these Hd. Qrs. as soon as it is apparent.  It is desired that the above work be done at once - in order that the orphans now at the Poor Farm near New Bern may be moved to the Lyon Pasture Plantation as soon as possible - together with such destitute refugees and freed persons as are now supported at the Poor Farm.  You will call on the Post Qr. Mr. for transportation of such lumber and material as is needed, from New Bern and from the Landing near the farm buildings.
