I have the honor herewith to enclose a copy of a letter from 1st Lieut. Ed B. Nerthup Asst Supt. B.R.F. and A.L. for Bladen County N.C. referred to these Head Qrs. by Bvt. Brig. Gen'l A. Rutherford Supt. So. Dist. of this State, relating to the manner in which a case of assault upon a freedman was disposed of, by one of the Justices of peace for Bladen County, at the last session of the county court there, and to the way in which the affair was treated by the spectators of the trial.

Having turned all cases of this nature over to the Civil Authorities, I deem it proper to refer this matter to your Excellency, calling your attention to the conduct of the magistrate alluded to.

When on receipt of your communication of date July 12" 1866, I issued General Orders No 3, I hoped no just cause of complaint would thereafter arise, as to the manner in which freedmen were treated by the courts, and I now regret to have to inform your Excellency that if Justices of the Peace, do treat cases where the freedman are concerned, in the manner reported in the enclosed letter, the Military Authorities will be compelled to resume jurisdiction as heretofore, and furthermore to state that if during legal proceedings before a magistrate, an officer of this Government cannot be protected by the Court, from outrageous insults and threats of violence, applications will have to be for sufficient military force in addition to that already here, to afford to United States officers, while in the discharge of their duties, that immunity from insult, that the civil authorities are unable or unwilling to secure them.

The Asst. Commissioner directs me to call your attention to Circular No 8 of date July 24" 1866, from these Head Qrs, and to ask you to report at once, what action, if any, has been taken to carry out its provisions.  [[Footnote 1]]

He further directs me to call your attention to the fact that but few copies of the required oath, signed by employees of the Bureau, have been received here, and to state, that no vouchers for services for this month, will be paid any person, except a copy of the oath, signed by him is on file in this office.
