I am directed by the Commanding Officer to request you to enter a Nolle Prosequi in the case of Private Frank Marshall Co F 8th US Infty now under bonds to appear Dec 3rd "66 at Elizabeth City for trial for an alleged Assault & Battery.  The defendent herein named being entitled to Protection under Par 7 General Orders No 15 Hd Qrs' Dept of South current series Copy enclosed

I have the honor to state that after an interview with the Governor of this State, I have felt the importance of referring for your decision, the following point relating to the apprenticing of children viz:
By the laws of this State, children are apprenticed at any age until they are twenty one.  By Circular No. 1. from Bureau Ref. Freedman and A.L. from Head Qrs. Asst. Com'r. Raleigh N.C. Feb. 16" 1866, it is directed that children over fourteen years of age should not be apprentised".  As I am only temporarily assigned to command of this State, during the absence of Gen. Robinson at Charleston S.C. I do not feel myself at liberty to deviate from any of the standing orders.  This is my reason for referring this matter.
