I am directed by the Actg Asst. Comr to say that your report touching the gathering of colored people in Edgecomb County is entirely satisfactory;  however the facts as stated constitute a criminal offence under the laws of this State, no overt act having been committed.  The Comdg General of the Dept. has forbidden the organization of any bodies or whites or blacks, bearing arms or intended to be armed (except the lawful enrollment of the Militia).
You are therefore requested at all times to ascertain the object of any such gathering, and if in your judgement, their object is for the armed purposes, you will at once interfere and prevent such assemblages or schemes.  Enclosed find copy of the order in the premises.

I have the honor to acknowledge the receipt of your communication of the 1st inst, and to thank you for your ready compliance in affording me the means of forming an opinion in the case, involving the provisions of the "Civil Rights Bill", arising from indictment against James F. Barnes and Elizabeth G. Chansey for larceny, through the clear and candid exposition of the Hon. Jessee G. Shepherd.
The case having gone to a higher court, I see no reason for interference on my part, interupting the legal routine.
