I have the honor to transmit herewith report of [[underlined]] Bt Maj Genl Robt Avery [[/underlined]] Inspect &c relative to charges preferred against [[underlined]] Horace James [[/underlined]] late Captain and Asst Quarter Mr U.S. Vols, as requested in your communication of 17th inst.
In regard to Officers of Volunteers who could be appointed as members of a General Court Martial, I beg leave to state that there are not a sufficient number available from those on duty in the Bureau to constitute a Court without seriously interfering with their other duties.
There are however four Officers of the 37 U.S.C.T. here awaiting orders the Court of which they were members having adjourned "Sine die".  Also [[underlined]] Capt Lumberton [[/underlined]] 107th U.S.C.T. for some time past on duty as recruiting officer for 40th US Infty - if these gentlemen can be made available I will name two Officers of the Bureau - and recommend the following detail.
Bvt Brig [[underlined]] Genl A. Goff Jr [[/underlined]]  Col 37 U.S.C.T.
Major [[underlined]] Wm A. Cutter [[/underlined]]  [[dittos for Col 37 U.S.C.T.]]

I am directed by the Asst Commissioner to say that you will cause the repairs to be made to the building you have kindly offered for Freedmans School at a cost not to exceed One hundred dollars the same will be paid by the Bureau, on your furnishing a statement of the expenditure.

I have the honor to transmit herewith a copy of a communication from Bvt Maj H.H. Foster Asst Supt Bureau R.F. & AL.  Numerous complaints have been received of the carelessness prevailing in Lenoir, Jones, Wilson and neighboring Counties and it is hoped some remedy can be found for its suppression.  I respectfully request to be informed whether an extra session of the Superior has been or will be ordered.
