Mitchell Alexa [[Footnote 1]]

Applies to have rents of his property which have accrued since Aug. 15" date of his pardon refunded to him his property having been restored Oct. 26"  Endsmt of Capt Seely Fincl Agt.  Respctfly forwarded.  As orders stand the applicant appears to be entitled to have these rents refunded, but the general refunding in such cases would make a very serious inroad on our finances.  The Presidents pardons appear to be untodated in most cases.  Respectfully returned to Capt. Seely, who will please state the amount of rents collected on the property of Mr. Mitchell since Aug. 15" 1865 & if any has been collected since the order of restoration was issued.

Submits statement relative to his getting possession of his property now in possession of and held by one Jeff James, freedman-claiming it as his own.  Endsmt of Maj. Wickersham-  Respectfully forwarded with the remark that the civil authorities refuse to act in this matter, they claim that they have no right to act in any difficulty in which one of the parties is a negro.  The Provost Marshall commenced to act in the matter when the negro applies to the Bureau for assistance.  I requested the Provost Marshall to turn the matter over to the Bureau under the Provisions of Par VIIII. Circular No. 5. War Dept. Bureau R.F & A.L.  Referring to letter of Asst. Comssr. State of N.C. of Oct. 14".  I find I have "no power to interfere."  The case is respectfully forwarded for the decision of the Asst. Commr.  Respectfully returned to Maj. Wickersham who will investigate the case fully.  If Mr. Wilson is the legal owner of the property, the tenant should be required to pay fair rents  The Bureau has no power to eject him by force, but if he refuses to act honestly, and defrauds the owner, he may be fined or imprisoned.

Respectfully asks permission to place his hogs on the land now leased as Abandoned until Jany 1" 1866. but restored and belonging to him.  Endst of Capt. J.C. Mann Fincl. Agt.  Respectfully referred to Col. E. Whittlesey Asst. Comr.  The question to be settled is an important one to the people here.  Some parties are unwilling that the owners should plow and prepare the ground &c. for the next seasons crop and as the restoration is subject to the lease of course I have no discretion in the premises.  The questions I should like settled are, 1" can the owners of plantations prepare the ground for next seasons crop before present occupant vacates on January 1" 1866. 2" Can the owner place his stock upon the plantation before termination of lease, provided it does not interfere with the crops.-  Respectfully returned.  The questions presented can only be settled by an amicable arrangement between the parties.  The Lessee has legal possession until the expiration of the lease; but in most cases, it must be an easy matter to secure the privilege asked, if a proper spirit is shown, I see no occasion for the interference of this Bureau.
