Makes application for restoration of his property in New Berne.  Endorsement of Capt. F A Seely.  Applicant has exhibited deeds in proof of title.  Is officially announced by Gov. Holden Oct. 30" as pardoned & has shown letter accepting the pardon-  Respectfully returned, until pardon has been received this Bureau has not the right to restore property

Respectfully returned to Capt Seely.  Until more definite instructions are received from Genl. Howard this and all similar applications must be held in abeyance.  Rents collected after [[underlined]] date of Restoration [[/underlined]] may be refunded, no others as our orders now stand.

Asks information in regard to the children of McLean Whitney. [[Footnote 1]] Endst. of Capt. J.A. Rosecrans Asst. Supt. New Berne-  Respectfully referred to Lt. Frank Barrows A. Supt. for investigation and report.  These papers to be returned.-  Endst of Lt. Frank Barrows  Respectfully returned to Capt. Horace James Supt. Freedmen.  There are no colored persons of such a description living in or near Kinston, diligent search has been made but no trace can be found of the the within named.  Endst. of Capt. Horace James Supt. E. Dist.  Respectfully returned to Col. Whittlesey, with the information that Mr. Van Bucklin's slaves did not go to Kinston but to Greensboro, and none there during the War.  Two of Whitney's sons have been seen in Wilmington within a fortnight by parties known to me, and it is believed that a reference of this paper to the Wilmington Dist. would elicit the information desired  Respectfully referred to Maj. States that D.H. Haughton has applied for rents accruing since June 24" date of Pardon.  The practice of refunding rents from date of Pardons would make a tremendous drain on our funds.  The property was not turned over by Treasury Dept until July 13"- Money collected before that date cannot be restored.  Respectfully forwarded for the information of Genl. Howard respecting the claims constantly presented, and for definite instructions. [[Footnote 2]]
