On July 1, 1976, the Smithsonian's interest in the real estate known as "Hillwood" and the collection of museum objects bequeathed to the Institution by Mrs. Marjorie Merriweather Post passed from the Smithsonian to the Post Foundation in accordance with the provision of Mrs. Post's Will which named her Foundation as subsequent owner should the Institution choose to relinquish title.

A subsidiary collection of museum objects, also physically located at Hillwood, had been given to the Smithsonian by various donors and was not covered by the terms of Mrs. Post's Will. The ownership of these items was conveyed to the Post Foundation's Hillwood Museum by resolution of the Board of Regents at its January 1978 meeting.

A few other museum objects, also related to Mrs. Post's interests in Hillwood and acquired with the general understanding that they would be displayed there, remained in the custody of the Smithsonian's National Museum of Natural History and National Museum of History and Technology.
