The State vs Plenty Pino } Pettit Larceny - In the District Court Williamsburgh District

This was an indictment for stealing grain from the field. It was proved that the Defendant rented land from S. B. Gordon, the Prosecutor, and that Gordon was to receive a certain portion of the produce in payment of the rent. From this land the Defendant had taken some corn for domestic purposes.

I instructed the jury that the Defendant was not a cropper with Gordon, but only his tenant, and that he was to pay for the use of the land in provisions: and that larceny could not be committee by the Defendant of what rightfully belonged to him. The jury thought otherwise, & found the Defendant guilty.

The defendant gives notice of appeal on the grounds annexed.
