I. Before a Military commission which convened at Raleigh, North Carolina, on the 1 th day of September, 1865, pursuant to Special Orders, No. 37, dated Headquarters, District of Raleigh, Raleigh, North Carolina, September 16th, 1865, and of which Major JOHN M. BARCUS is President, were arraigned and tried:

1. Guion Earp, Citizen.

CHARGE I.

Treating Negroes as slaves, in violation of the requirements of the Proclamation of the President of the United States, of date January 1, 1865, and of General Orders, No. 32 Headquarters Department of North Carolina, dated Raleigh, North Carolina, April 27th, 1865.

CHARGE II.
Larceny.

CHARGE III.
Maltreatment of Freedmen and Assault and Battery.

FINDING.
CHARGE I.--"Not Guilty."
CHARGE II--"Not Guilty."
CHARGE III.--"Guilty."

SENTENCE.
To imprisonment for the term of thirty (30) days at such place as the commanding General may direct.
II. Gilbert Allen, (Colored) Citizen,

CHARGE.
Larceny.
FINDING.--"Guilty"

SENTENCE.
To hard labor on some public works for the term of two (2) years, at such place as the Commanding General may direct.

III.  Ashley Byron, (Colonel) Citizen.

CHARGE.
Arson.
FINDING: "Not Guilty."
