Maysville N.C March, 9, 1867

Examination of Rob't H Lyon Constable taken on oath before me this day who Saith that on or about the 20" of January he received a warrant signed by J.R. Kemp Esq. in which David Patterson was Plaintiff & Levi McMillan defendant and that the said Levi McMillan was preparing to make his departure from the County & consequence the Plaintiff acquired special bail of the defendant Officer Lyon further sweareth that he being in doubt which course the defendant McMillan would pursue in his departure, that he summoned to assist him in his duties Alexander Patterson a party entirely unconnected with debt so set forth in the warrant & that he the said Alex Patterson did arrest the said Levi McMillan & tie him & deliver him to the Said R H Lyon bonded & sworn officer & then he the Said R.H Lyon officer did about dark cause to be tied the Said Levi McMillan & did surrender him the next day for trial before C.T. Davis Esq who rendered Judgt against the Said Levi McMillan for the Sum of Forty five dollars & interest costs, & that he the Said Levi McMillan did of his own accord offer to hire David Patterson his son till the debt was paid, & that the price was fixed by the said Levi McMillan, provided
