Magnolia NC April 20th 1867 Capt. Rutherford Sir Through your request (recd the 11th inst) I appointed (TW Boney, CC Boney, & Stoaks Wills) three freeholders and with them, went to the house of Joseph Rhoads, to lay off and assign to him the property which he should be entitled to, under paragraph 8, Chapter 45 Revised Code N.C. On inquiry we found nothing [[strikethrough]] was [[/strikethough]] in his possession that was worth mutch to himself, and would be worth nothing to any one else. The defendant Rhoads had seven (7) Hogs and about two (200) hundred lbs fodder, which was executed, and in the custody of the Sheriff, therefore we could not assign them to the defendant, according to
