104 Nashville Tenn. Dec. 7-1874 Col Geo. Gibson 5th Inf. D.O. F.B. Memphis Tenn. Sir: I respectfully make the following report with reference to the disposition of the cases of Samuel Beasely and Allen Bentford, colored, witnesses for one Jack Cartwright who represented himself at this office as being Charles Millhouse late Prvt. Co. "C" 111th C.T. and who failed to obtain the Bounty &c. but was sent to the Penitentiary for three years, mention of which case was made in Major La Motte's letters to the Adjutant General, U.S.A. dated respectively Jany. 19th and May 25th 1974. That the witnesses Beasely and Bentford were brought to trial during the present term of the Federal Court, held in this place, and it appearing that there was no collusion between them & the principal, and that there was no intent on their part to defraud the Government a nolle prosequi was therefore entered in their case by the Dist. Sir: I have the honor to make the following report with reference to the disposition of the cases of Jackson Payne, colored, one of the two witnesses for Fayette or Fed Robinson, the latter representing himself at this office as being Joshua Butler, late Prvt. Co. B 15th U.S.C.T. mention of which was made in Major La Motte's letters to the Adjutant General, U.S.A. dated respectively, Dec. 8th 1873, April 4th and May 25th 1874. That the said party who was arrested as being the witness Payne, was tried during the present term of the Federal Court, held in this place, and was acquitted. All the witnesses stated that they were satisfied that he was the identical 105 Jackson Payne, but as none of them could qualify positively as to this the jury therefore after a long consultation gave him the benefit of the doubt. Would state in connection with this case that the U.S. Marshal informed me that the principal, Fayette Robinson was reported as being in St. Louis, and that he expected to be able to apprehend him within a reasonable time.
